Who Can Use PendingMoney

By using PendingMoney, you confirm that:

• You are a United States resident
• You are at least 18 years old
• You have the legal right to enter into this agreement
• You will use PendingMoney only for lawful purposes and in accordance with these Terms
• All information you provide is accurate and truthful

If you don't meet these requirements, you may not use PendingMoney. We reserve the right to suspend or terminate your account if we have reason to believe you've violated this section.

What PendingMoney Is and Is Not

What we are:

• A tool to help you search public settlement databases, match you to eligible claims, and prepare them for you to file
• A deadline tracker for claims you've filed
• A service that simplifies a process you could do yourself (for free) by filing directly

What we are NOT:

• Not a law firm. We don't provide legal advice. Don't treat our communications as legal guidance.
• Not your lawyer. We don't represent you in any legal sense. No attorney-client relationship exists between you and PendingMoney.
• Not a guarantee of payment. Finding you as eligible for a claim does not mean you will receive payment. Settlement outcomes are uncertain and depend on factors beyond our control (claim approval, administrator decisions, fund availability, etc.).
• Not claiming any settlements. Claims are public records. You have the right to file them yourself at no cost. We charge for convenience, not exclusivity.
• Not responsible for claim outcomes. If a claim is denied, pays less than expected, or disappears due to fraud, we are not liable for lost income or damages.

Your Account & Your Responsibilities

Account creation: You are responsible for maintaining the confidentiality of your login credentials. If someone else uses your account, you are liable for their actions. Notify us immediately at support@pendingmoney.us.com if you suspect unauthorized access.

Accuracy: You agree to provide accurate, truthful, and complete information. We rely on this information to match you to settlements. If your information is false, we are not responsible for claims prepared using it, and we may terminate your account.

Review and approval: For each claim, we'll show you a summary of what we found and prepared - who it's from, what you may be owed, and the official link to file it. You review it and file it yourself. We do not submit claims to settlement administrators on your behalf.

Staying informed: We'll send you emails when claims are filed, denied, approved, or about to expire. It's your responsibility to read these and act on deadlines. We will not be liable if you miss a notification.

Subscription, Billing & Pricing

Free eligibility check: You can search for settlements in your name and see eligibility at no cost. No subscription required to use this feature.

Paid subscription: To have us find, prepare, and track claims for you, you need a paid subscription:

• Monthly: $12.00/month (subject to change with 30 days' notice)
• Annual: $79.00/year (subject to change with 30 days' notice)

Billing & payment: Subscriptions renew automatically. Your payment method will be charged on the renewal date. If payment fails, we will attempt to retry and then may suspend your account. You can update or remove your payment method anytime in your account settings.

Money-back guarantee: If you're not satisfied with PendingMoney within 30 days of your first payment, contact us at support@pendingmoney.us.com for a full refund. This applies once per customer. Refunds are processed within 5-7 business days.

Taxes: Subscription prices do not include sales tax, VAT, or other applicable taxes. You are responsible for any taxes owed based on your location.

Cancellations & Refunds

Cancel anytime: You can cancel your subscription at any time through your account settings or by emailing support@pendingmoney.us.com. Your access will end at the end of your current billing period.

Refunds: With the exception of the money-back guarantee above, subscription fees are non-refundable. If you cancel mid-month, you will not receive a pro-rata refund; your service continues until your billing period ends.

No refund for claim outcomes: We do not refund subscription fees if a claim is denied, pays less than expected, or doesn't resolve as you hoped. Claim outcomes are uncertain and outside our control.

Acceptable Use

You agree not to:

• Use PendingMoney for any illegal purpose or in violation of any law
• Provide false or fraudulent information (e.g., pretending to be someone else to file claims in their name)
• Attempt to access other users' accounts or data
• Disrupt, damage, or overload PendingMoney's servers or systems
• Reverse-engineer, decompile, or attempt to extract proprietary information
• Use automated tools or bots to scrape data or file claims
• Harass, threaten, or abuse PendingMoney staff
• Submit frivolous or abusive refund or complaint requests to exploit the money-back guarantee

If we discover you've violated these rules, we may suspend or terminate your account without notice, and we may report you to law enforcement if appropriate.

Intellectual Property

PendingMoney, including its design, layout, and software, is owned by PendingMoney, Inc.. You are granted a limited, non-exclusive license to use PendingMoney for personal, non-commercial purposes. You may not copy, modify, distribute, or sell any part of PendingMoney without our permission.

Disclaimers & Limitation of Liability

No warranties: PendingMoney is provided "as is" without any warranties, express or implied. We don't guarantee that:

• PendingMoney will be uninterrupted, error-free, or virus-free
• Any settlement match is complete or accurate
• Any claim will be approved or result in payment
• Claim outcomes will match settlement summaries or advertised amounts

No liability for claim outcomes: This section governs how disputes between you and PendingMoney are resolved. By using the service, you agree that disputes will be handled through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. You may opt out of arbitration within 30 days of your first use by emailing support@pendingmoney.us.com with "Arbitration Opt-Out" in the subject line.

Third-party content: PendingMoney relies on public settlement data, government databases, and information from settlement administrators. We are not responsible for errors, omissions, or changes in that data. You should verify critical information independently.

Dispute Resolution & Arbitration

Governing law: These Terms are governed by the laws of Delaware, without regard to its conflict-of-law provisions.

Informal resolution: If you have a dispute with PendingMoney, email us at support@pendingmoney.us.com and we'll do our best to resolve it within 30 days.

Binding arbitration: This section governs how disputes between you and PendingMoney are resolved. By using the service, you agree that disputes will be handled through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. You may opt out of arbitration within 30 days of your first use by emailing support@pendingmoney.us.com with "Arbitration Opt-Out" in the subject line.

By accepting these Terms, you agree that any dispute will be resolved through binding arbitration rather than in court, except for disputes within small-claims court jurisdiction, which you may pursue there if you prefer.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll notify you by email or post a prominent notice on PendingMoney. Your continued use of the service after changes take effect means you accept the new Terms. If you disagree with changes, you may cancel your subscription.

Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced here, make up the entire agreement between you and PendingMoney regarding your use of the service. If any part of these Terms is found to be unenforceable, the rest remains in effect.
